Terms of Service

These Terms are the public offer of Almavi (Portugal). By placing a request you accept these Terms and enter into a service agreement. The service provider's details are given at the end of the document.

1. Definitions and parties

“Almavi”, the “Service Provider”, “we” — a sole trader (empresário em nome individual) registered in Portugal and trading under the name Almavi. The Service Provider's name, tax number (NIF) and address are given in the “Service provider details” section at the end of these Terms.

The “Customer”, “you” — the person who places a request. The Customer acts as principal (comitente), on whose instruction and for whom the item is purchased, and as consignee of the international shipment.

An “Order” is the Customer's instruction to purchase and deliver a specific item. A “Parcel” is an international shipment; its accompanying document is the waybill.

2. Subject of the agreement

Almavi provides the Customer with services for purchasing the item chosen by the Customer from retail stores in the European Union and delivering it internationally, including consolidation of shipments and export formalities.

Purchases are made under a commission agreement (contrato de comissão, Article 266 of the Portuguese Commercial Code): Almavi buys the item from the store in its own name on the Customer's instruction and acts as the exporter of the goods. The price of the item for the Customer is the store's retail price, confirmed by Almavi before payment; Almavi's remuneration is the cost of its services (section 7).

Ownership of the item passes to the Customer when the shipment is handed over to the carrier for export from the European Union.

3. Offer and conclusion of the agreement

These Terms are a public offer. Placing a request (including via the website and the Telegram bot) constitutes full and unconditional acceptance of the Terms and conclusion of the service agreement.

The agreement is concluded when Almavi confirms the availability of the item and its final price.

4. How we provide the services

Standard process: Customer's request → confirmation of availability and price → payment of the first invoice → purchase of the item in Portugal (with photo proof) → consolidation at the warehouse → payment of the second invoice (international delivery) → dispatch and tracking number.

5. Delivery: methods, destinations and timeframes

International shipments are handed over to CTT (Correios de Portugal), including its EMS express service, or to DHL Express; in the destination country the parcel is delivered by the national postal or courier service. The service is chosen according to the destination, weight and dimensions of the shipment.

Destinations: Russia, Belarus, Kazakhstan, Kyrgyzstan, Azerbaijan, the UAE and Ukraine; other countries outside the EU on individual request. Indicative transit time for most destinations is 5 to 21 days, excluding purchase and consolidation; timeframes by country are listed on the “Delivery” page and are not guaranteed (section 10).

The delivery cost depends on the carrier, weight, dimensions and destination; it is calculated once the parcel is formed and communicated to the Customer before payment. The Customer receives a tracking number for every shipment.

6. Use of third parties

To perform the agreement Almavi may engage third parties: postal and courier services (CTT, EMS, DHL and similar), customs representatives for customs clearance, and licensed payment service providers.

7. Price and payment

The price consists of the item's price at the brand's store, Almavi's service fee and the delivery cost. Prices are stated and calculated in euro (EUR). Payment is made in two invoices: the first covers the item with delivery to the warehouse in Portugal and Almavi's services, after availability is confirmed and before purchase; the second covers international delivery, once the parcel is formed and before dispatch. The amount of each invoice is communicated to the Customer before payment.

Payment methods:

  • Visa or Mastercard bank card — on the secure payment page of a licensed payment service provider; card details are entered on the provider's side, and Almavi neither receives nor stores the full card number or CVV. Card payment is available for shipments to Kazakhstan, Kyrgyzstan, Azerbaijan, the UAE and Ukraine; cards issued by banks in Russia and Belarus are not accepted for any destination — such a payment is declined;
  • USDT cryptocurrency — for all destinations, and the only payment method for shipments to Russia, Belarus and countries served on individual request. The USDT amount is calculated from the euro amount and stated in the invoice.

The payment methods available for a particular order are shown when it is placed. When paying in cryptocurrency, the payment may be made on the Customer's behalf by a third party; the costs of acquiring the cryptocurrency and any exchange-rate difference are borne by the payer.

8. Customs duties and taxes

All import duties, taxes and fees charged in the destination country are paid by the recipient. Almavi is not liable for decisions of the destination country's customs authorities or for related delays.

9. Trademarks and Customer warranties

Brand names and logos belong to their owners; Almavi is not affiliated with the brands and does not officially represent them.

The Customer confirms that the goods are purchased for personal use and warrants that no third parties (including right holders and stores) will raise claims in connection with the order. The Customer releases Almavi from liability and indemnifies it against any such claims.

10. Limitation of liability

Delivery times are indicative and cannot be guaranteed: they depend on carriers, customs clearance and force majeure.

Almavi's liability is limited to the cost of the relevant services and does not extend to lost profits or indirect damages. Claims for damage to a shipment are accepted with a video recording of the parcel being opened; the claim period is 30 days from the date of receipt.

11. Refunds and cancellation

Every refund is made to the original payment method — the one used to pay (bank card or cryptocurrency). There is no internal balance, and refunds are never replaced with bonuses.

The Customer may withdraw from the order before the item is purchased. If the item is out of stock or cannot be purchased, the amount paid for it is refunded in full. Once purchased, the item has been bought for the Customer's specific order, so the possibility of returning it is limited by applicable law; the cost of services already rendered (for example, delivery) is not refundable, except where required by law.

A refund is initiated within 5 business days after it is agreed; the time for the funds to arrive depends on the issuing bank or payment service provider. To request a cancellation or refund, contact support and state the order number.

12. Personal data and payment security

Almavi processes personal data in accordance with the GDPR. Bank card details are entered only on the payment service provider's secure page; Almavi neither receives nor stores the full card number or CVV. The data processed, purposes, security measures and data subject rights are described in the Privacy Policy.

13. Sanctions restrictions and prohibited persons

Almavi does not provide services to persons included in the consolidated sanctions lists of the European Union, the UN and other applicable jurisdictions. By placing a request, the Customer confirms that they are not such a person and do not act on behalf of one.

For shipments to Russia and Belarus the EU export restriction applies: the value of a single item may not exceed €300 (for Russia — Article 3h of Council Regulation (EU) No 833/2014; for Belarus — the restrictions of Council Regulation (EC) No 765/2006); orders above this limit are not accepted.

The assortment is limited to goods not subject to EU export and sectoral restrictions. Almavi may refuse the service or cancel an order if the goods, the destination or the circumstances of the transaction do not comply with applicable rules.

For cryptocurrency payments, Almavi and the regulated providers it engages may check the source of funds and reject payments from addresses flagged as high-risk or linked to sanctioned persons.

14. Governing law and dispute resolution

These Terms and the relationship between the parties are governed by Portuguese law. Disputes not settled by negotiation are subject to the competent courts of Portugal.

Consumers may refer a dispute to a consumer alternative dispute resolution (ADR/RAL) entity, including CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo; the list of entities is published on the Consumer Portal. A complaint may also be filed in the electronic Complaints Book (Livro de Reclamações).

15. Changes to the Terms and contacts

Almavi may amend these Terms; the current version is published on the website with its version date. Support is available via the Telegram bot and by e-mail, as listed on the “Contacts” page.
